Terms of Use for School Support Hub
Your use of Cambridge Assessment International Education’s (“Cambridge International”) extranet at https://schoolsupporthub.cambridgeinternational.org/ (“the Site”) is governed by these Terms of Use. Please read these Terms of Use carefully before you start to use the Site. By accessing the Site you agree to these terms of their entirety.
Cambridge International is part of Cambridge Assessment, the brand name of University of Cambridge Local Examinations Syndicate (UCLES), a department of the University of Cambridge (formally known as the Chancellor, Masters and Scholars of the University of Cambridge).
Any reference to “you” or “your” shall refer to the organisation contracted with Cambridge International, and any of that organisation’s employees, representatives, associates, personnel or contractors including any employees, representatives, associates, personnel or contractors of any school of that organisation, and any other person authorised or admitted by that organisation to access this Site.
1. Accessing the Site
1.1 by inputting your username and password to access the Site you are agreeing to the following terms and conditions of use (“the Terms of Use”) and confirm that you have read them.
1.2 If you do not agree with any part of the Terms of Use you must cease use of the Site immediately.
2. General
2.1 These Terms of Use fully incorporate the terms of your main educational services contract with Cambridge International (the “Main Contract”), including but not limited to all clauses relating to Payment, Data Protection, Intellectual Property Rights, Confidentiality, Indemnity and Liability.
2.2 These Terms of Use are a legal agreement between you and Cambridge International. The Terms of Use may only be amended with Cambridge International’s prior written consent. Cambridge International reserves the right to amend the Terms of Use at its discretion at any time. Cambridge International shall not be obliged to notify you of any such amendments other than by uploading the amended Terms of Use to the Site.
2.3 You may print and keep a copy of these Terms of Use. However, for the avoidance of doubt, the applicable terms shall be those uploaded to the Site from time to time in accordance with Clause 2.2.
2.4 Where you are using the Site as part of your duties of employment, you confirm that you are authorised to agree to these Terms of Use on behalf of your employer.
2.5 As a registered user (“User”) you may access the Site only by using the password and username provided.
2.6 You may agree to follow any guidance or instruction provided in support of the Site, including but not limited to any on-line help or telephone support. Cambridge International shall not be liable for any damage or loss whatsoever caused by failure to follow Site guidance.
3. Accuracy of Information and Disclaimer
3.1 Cambridge International shall use its reasonable endeavours to ensure that all information on the Site is accurate.
3.2 Any reliance on any information or other material contained on the Site is entirely at your own risk.
3.3 You acknowledge that Cambridge International is unable to guarantee uninterrupted access to the Site, and that Cambridge International may need to restrict or prevent access from time to time due to maintenance or technical issues.
3.4 Where possible, Cambridge International shall carry out the Site maintenance outside core operating hours, and shall minimise the period of any disruption where commercially reasonable to do so.
3.5 Cambridge International shall not be liable for any circumstances beyond their control that affect the availability or reliability of the Site.
4. Code of Conduct
4.1 All personal details you supply to Cambridge International through the Site must be accurate and you shall let Cambridge International know promptly if any details supplied have changed.
4.2 The user account may only be used by the person to which it was issued and you must not share your username or password.
4.3 You must keep your username and password for the Site confidential, and you are responsible for any loss or damage to Cambridge International or any third party, including other Users, or any accrued costs or fees for your account, resulting from use of your username and password by any third party.
4.4 Cambridge International reserves the right to terminate your access to the Site without notice should it consider that your use of the Site is detrimental to Cambridge International, the Site, other Users or for any other reason including, but not limited to, your breach of the Terms of Use.
4.5 By accessing the Site you agree:
4.5.1 not to use the Site in such a way that disrupts, interferes with or restricts the use of the Site by other Users;
4.5.2 to ensure that any materials uploaded, displayed or transmitted by you through or to the Site are not false, offensive, defamatory, threatening, obscene, unlawful, corrupted and do not breach or infringe the rights of any person anywhere in the world and you waive any moral rights in respect of any such materials;
4.5.3 to only post materials to which you have the rights to post;
4.5.4 not to reverse engineer, decompile, copy or adapt any software or other code of scripts forming part of the Site nor attempt to transmit to or via the Site any information, document, software or other electronic system that contains a virus, worm, Trojan horse, or other harmful or disruptive component;
4.5.5 not to send spam email or any unsolicited correspondence that is unrelated to the business of Cambridge International to any addresses made available on the Site; and
4.5.6 not to change, modify, delete, interfere with or misuse data contained in the Site entered by or relating to any third party User of the Site.
4.6 If your breach of any of these Terms of Use results in Cambridge International suffering any loss of damage, you agree to indemnify Cambridge International for such loss or damage.
4.7 It is your responsibility to ensure you have appropriate protection against computer viruses, worms, Trojan horses or other items of a destructive nature whilst using the internet, and that your connection to the Site is secure. Failure to do so shall not act as a defence to any breach of these Terms of Use.
5. Payments
5.1 The Site may include products and services offered by Cambridge International available to purchase.
5.2 Any products or services selected by you will be subject to the payment terms in the Main Contract, and shall be invoiced under the Main Contract.
6. Links
6.1 The Site may include hypertext links to third party web sites. Cambridge International accepts no responsibility for, and can give no warranties, guarantees or representations in respect of, the content or availability of material of any third party Site.
6.2 You shall not create any hypertext link to the Site or any part of it from outside the Site or otherwise, without prior written agreement from Cambridge International.
7. Data Protection
By registering to access secure areas on this Site, you consent to us processing your personal data in accordance with our Data Protection and Privacy statements.
8. Posting information to the Site
8.1 You give Cambridge International an unconditional, royalty-free, non-exclusive, sublicenceable, perpetual licence in the material that you post to copy, modify, redistribute or otherwise use, without any further consideration being due to you and without attribution.
8.2 You hereby waive all moral rights under the Copyright, Designs and Patents Act 1988 that you may have in respect of the material that you post.
8.3 You hereby warrant that:
8.3.1 You own, or are licenced to use and sub-licence to Cambridge International, all intellectual property rights in the materials posted;
8.3.2 the material you post is not defamatory and does not infringe any UK laws; and
8.3.3 you have the consent of anyone who is identifiable in material or the consent of their parent or guardian if they are under 16 to post on the Site.
8.4 You agree to indemnity Cambridge International against any and all legal action, expenses, loss or damages howsoever arisen that may result from your posting the material.
8.5 Cambridge International may terminate your right to post material, or your account, should any material you post not, in Cambridge International’s sole opinion, be suitable for posting on the Site.
9. Governing Law and Jurisdiction
These Terms of Use shall be governed by and construed in accordance with English law. Each party irrevocably agrees to submit to the exclusive jurisdiction of the Courts of England and Wales in respect of any claim or matter arising under or in connection with these Terms of Use.
